As we've just discussed, if you wish want to obtain get a divorce, you must make your claim under the ''Divorce Act''. If you wish to obtain an order dealing with property or debt, you must make your claim under the ''Family Law Act''. However, if you want to make a claim about parenting children, child support and spousal support, you can make your claim under either piece of legislation. But that's not all.
Only ''married spouses'' can make applications under the ''Divorce Act'', while ''married spouses'', ''unmarried spouses'', ''parents'' and other unmarried people may all make applications for relief under the ''Family Law Act''. Also, the Provincial Court can only deal with claims under some parts of the ''Family Law Act'' while the Supreme Court can hear claims under the ''Divorce Act'' and all of the ''Family Law Act''.
